Tip for November 2014

Be aware of impaired lawyers under your management or supervision

Lawyers who are impaired are likely to make errors or omit to take some necessary action. The ethics rules impose duties on managing and supervising attorneys, making them responsible for the actions and omissions of other lawyers under certain circumstances. If you are either a manager of a law firm or the supervisor of another attorney, and you become aware that a lawyer in your firm is impaired, you need to take action to prevent the impaired lawyer from harming a client's case or from violating one or more rules of professional conduct.
