What To Do When Served With A Subpoena

When a lawyer is served with a subpoena related to the representation of a client, first consider retaining counsel.  Complying with a subpoena is a legal matter for which you should have the advice of counsel.  Other issues to be addressed are notification of your malpractice insurance carrier of the subpoena, investigate the circumstances giving rise to the subpoena to assess your potential exposure and to discharge professional responsibilities owed to the client, determine what objections to raise at the outset and during compliance with the subpoena, and prepare for his testimony just as if you were a party to the underlying case.
