Remember to send "litigation hold" letters to clients

Whenever your client reasonably anticipates an investigation or adversarial proceeding of any kind, be sure to protect yourself by sending a "litigation hold" or "document retention" letter to the client, advising the client to preserve all documents, correspondence, etc. related to the anticipated investigation or adversarial proceeding.  Note that "reasonable anticipation" often occurs before a complaint is filed and served.
